Information clause for individuals whose data is processed through social media.

INFORMATION ON THE PROCESSING OF PERSONAL DATA

In regard to the application of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (referred to as “GDPR”, “General Data Protection Regulation”), and due to the acquisition of your personal data in connection with the Organization’s social media profiles, we inform you that:

I. Administrator

The administrator of your personal data is Dobrzanski Bzymek – Waśniewska Sroka – Maleta Kancelaria Radców Prawnych s.c., 4/12 Wilhelma Feldmana Street, 31-130 Krakow (hereinafter: Administrator or Organization).

II. Purpose and basis of personal data processing

Your data will be processed only if the Administrator or other processor has a legal basis under the GDPR and only for a purpose tailored to that basis.

Your personal data may be processed by the Administrator for the purposes of running a fanpage on Facebook, or a profile on LinkedIn, which includes:

  1. informing you about our activities, promoting or informing you about events that we organise or participate in, promoting our products and services, as well as for communicating with you through the available functionalities (due to the fact that you subscribe to our fanpage or profile by clicking the “Like” or “Observe” icon [Facebook] “Recommend” or “Observe” [LinkedIn] “Like”, adding comments on our profile, clicking on reactions under posts, sharing posts, chat, or messages). We process your personal data on the basis of our legitimate interest to promote our brand, products and services, to build and maintain a community with us and for the purpose of communicating with you on the basis of the consent you have given by liking our fanpage or profile [Article 6(1)(f) GDPR and Article 6(1)(a) GDPR].
  2. archiving to secure information in the event of a legal need to prove events or facts, which is our legitimate interest [Art. 6(1)(f) GDPR].
  3. the possible establishment, investigation or defence of claims, which is our legitimate interest [Article 6(1)(f) GDPR].
  4. data analysis, which is our legitimate interest [Article 6(1)(f) GDPR].

III. Information on recipients or categories of recipients of personal data

The Administrator shall make personal data available to the owner of the social network Facebook, i.e. Facebook Inc. or LinkedIn, i.e. LinkedIn Ireland Unlimited Company, and to the extent that this is necessary to ensure the functioning of the fanpage on Facebook or LinkedIn and to other users of this portal.

In every case, the transfer of your data does not entitle the entity that is the recipient of the data to use it freely, but only to use it for the purposes expressly indicated by the Administrator. Recipients of your data may also be entities entitled to obtain your data on the basis of the provisions of the applicable law, such as courts or law enforcement agencies – if they make a request for data access based on an appropriate legal basis. Your data may also be made available to the Administrator’s consultancy service providers and contractors.

IV. Transfers of data to third countries or international organisations

The Administrator using Facebook and LinkedIn may transfer your data to the United States or other countries outside your country of residence. These data transfers are necessary for the provision of the services specified in the Terms and Conditions of the portals. Facebook Inc. and also LinkedIn Ireland Unlimited Company use typical contractual clauses approved by the European Commission. In addition, Facebook Inc. relies on decisions by the European Commission finding an adequate level of data protection for certain countries, where applicable, for data transfers from the EEA to the United States and other countries. In other cases, the Administrator does not transfer your data to third countries or international organisations.

V. Period for which personal data will be kept

Your data will be processed until there is a basis for processing.

When the basis for data processing is the legitimate interest of the Administrator, the administrator will keep your data until that legitimate interest exists, periodically reviewing their continued relevance.

In situations where the processing of data will take place in the performance of a legally prescribed obligation, the data retention period will be determined by the relevant legal provisions.

If you withdraw your consent to data processing (withdrawal of liking/observing your profile on the portal), the Administrator will no longer process your data in the list of followers/observers from this point on.

VI. Rights in relation to the processing of personal data

You have the right to access your data and to request their rectification, erasure and restriction of processing.

You have the right to data portability and the right to object to processing.

You have the right to withdraw the consent you have given for the processing of your data by revoking the liking/observing of the profile on Facebook or LinkedIn. The withdrawal of consent for the processing of your personal data does not affect the validity of the Administrator’s existing processing of this data on the basis of this consent.

You have the right to lodge a complaint with a supervisory authority if you consider that the Administrator is processing your personal data in violation of the law.

VII. Obligation to provide personal data

The provision of personal data is voluntary.

VIII. Changing the content of the notification

The content of this information may be modified from time to time by the Administrator. In such a case, the Administrator will inform you of such a change.

Note that if you have a profile on Facebook or LinkedIn, the Administrator of your data is also Facebook Inc. or LinkedIn Ireland Unlimited Company, who, depending on the regulations and consents you have given, may act differently.
